These Terms of Use (“Terms”) govern your use of grapevinecigarshop.com and any related pages, checkout, or account tools operated by Ole Grapevine Cigar & Tobacco Shop (“Grapevine,” “we,” “us,” or “our”). By visiting the site, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Return Policy (together, the “Additional Terms”). If you do not agree, do not use the site.
1. Age restriction
You must be at least 21 years old to use this site or buy anything from us. By using the site you confirm that you are 21 or older. We may verify your age at checkout and again at delivery. We do not knowingly collect information from, or sell tobacco products to, anyone under 21.

3. Using the site
We grant you a limited, personal, non-transferable license to browse the site and place lawful orders. You may not copy the catalog for a competing store, scrape the site, try to break security, post malware, impersonate us, or use the site for anything illegal. We may suspend access if we believe these Terms have been violated.
Product photos, names, descriptions, prices, and reviews on the site are for shopping on grapevinecigarshop.com. Brand names and trademarks belong to their owners. We do not claim those marks as our own.
4. Accounts
You may create an account at My account. You are responsible for the email and password you use and for orders placed while signed in. Tell us right away if you think someone else used your account. We may close accounts that we reasonably believe are used by someone under 21 or in violation of these Terms.
5. Orders, pricing, and availability
A listing on the site is an invitation to order, not a guarantee that the item is in stock. We may cancel or limit an order if an item is unavailable, a price or description is clearly wrong, we cannot verify your age or address, or we believe the order is fraudulent. If we cancel after you have paid, we will refund the amount charged for that item.
Prices, taxes, and shipping are shown at checkout and may change. Typographical errors happen. We are not obligated to honor a price that is an obvious mistake.
6. Tobacco products
Cigars and other tobacco products are intended only for adults of legal smoking age. Smoking and tobacco use involve health risks. Nothing on this site is medical advice. You are responsible for complying with the tobacco laws that apply where you live. We ship only within the United States and only where we can legally do so. See the Shipping Policy for delivery rules, including adult signature.
7. Content you send us
If you send reviews, comments, photos, or other material, you keep ownership of what you created, but you give us a non-exclusive right to use it on the site and in our shop marketing. Do not send anything you do not have the right to share, and do not send unlawful, infringing, or underage content. We may remove user content at our discretion.
8. Copyright concerns
If you believe something on the site infringes your copyright, email info@grapevinecigarshop.com with your contact information, the work you own, the URL of the material you object to, and a statement that you have a good-faith belief the use is not authorized. We will look into complete notices.
9. Disclaimer
The site and all products are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Cigars are natural products; appearance, draw, and taste can vary. We do not promise uninterrupted or error-free service.
10. Limitation of liability
To the fullest extent allowed by law, Ole Grapevine Cigar & Tobacco Shop and its owners, employees, and agents are not liable for indirect, incidental, special, or consequential damages, or for lost profits, arising out of your use of the site or any product. Our total liability for any claim related to an order is limited to the amount you paid us for that order. Some states do not allow certain limitations; in those states our liability is limited as far as the law allows.
11. Indemnity
You agree to defend and hold us harmless from claims that arise from your misuse of the site, your violation of these Terms, or your violation of any law or third-party right, except to the extent a claim is caused by our own misconduct.
12. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Except where the law requires otherwise, you agree that courts located in Tarrant County, Texas are the proper venue for disputes that are not resolved informally. You may also have rights under the consumer-protection laws of the state where you live.
13. Changes
We may update these Terms by posting a new version on this page and changing the effective date. Continued use of the site after a change means you accept the updated Terms. The version that applied when you placed an order still governs that order.
